New National Phase Patent Application (PCT system):
- Documents that must be filed simultaneously to the Indonesian Patent
Office along with the application on the day of filing:
- copy of PCT Request Form.
- copy of front page of PCT Publication Pamphlet.
- copy of amended claims, if any.
- Specification:
must have been translated into Indonesian by the time of filing
the application. In view of this condition, it is advisable to
have the specification and claims (may be sent by fax or email) translated
earlier.
- Drawing:
Informal drawings (may be sent by fax or email) will be sufficient. Formal
drawings prepared on your side are useless since it should be
re-prepared and translated into Indonesian.
- Power of Attorney:
merely signed, no legalization required (may be sent by fax or
email, with the understanding that the original should be submitted
to Patent Office within 10 days).
- Documents that should be followed:
- copies of PCT Forms no. PCT/IB/332; PCT/IPEA/401; PCT/IPEA/409;
and PCT Search Report along with English translations thereof
(in case the said PCT Forms are non-English):
should be filed with the Indonesian Patent Office within three
months as from the filing date, with the possibility to have one
time an extension of time for one month.
- Assignment:
should be followed within three months as from the filing date,
with the possibility to have only one time extension of time for
one month.
- English translation of the Priority Document (only if requested
by the Indonesian Patent Office):
Please note that the uncertified English translation is sufficient,
and it should be submitted prior to the substantive examination
request. The deadline for the substantive examination request
is 36 months as from the international filing date.

Filing New Patent Application (non PCT system)
- Documents that should be due by the time of filing:
- Specification:
must have been translated into Indonesian by the time of filing
the application. In view of this condition, it is advisable to
have the specification and claims (may be sent by fax or email) translated
earlier.
- Drawing:
informal drawings (may be sent by fax or email) will be sufficient. Formal
drawings prepared on your side are useless since it should be
re-prepared and translated into Indonesian.
- Power of Attorney:
merely signed, no legalization required (may be sent by fax or
email, with the understanding that the original should be submitted
to the Patent Office within 10 days as from the filing date)
- Documents that should be followed:
- Assignment:
should be followed within three months as from the filing date,
with the possibility to have only one time extension of time for
one month.
- Priority Document (if any):
should be followed within three months as from the filing date,
with the possibility to have only one time extension of time for
one month.
- English translation of the priority document (only if requested
by the Indonesian Patent Office):
Please note that the uncertified English translation is sufficient,
and it should be submitted prior to the substantive examination
request. The deadline for the substantive examination request
is 36 months as from the filing date.
